Booking Terms & Conditions

1. The owner (and the owner’s representatives) will not be liable for any act, neglect or default on the part of any person nor any accident, damage, loss, injury, expense or inconvenience whether to person or property which the tenant or any other person may suffer or incur arising out of or in any way connected with the letting or resulting from any other cause whatsoever. We advise you to arrange your own insurance to cover yourselves and your personal belongings whilst staying at the property.

2. The refundable damage deposit (3000 Eur) will be paid with the balance payment. The tenant will be held responsible for any claims up to the amount of the existing damage deposit. The owner has up to 7 days after the tenant checks out to make a claim.

3. After departure, if the property is left in such a condition that we will have to employ extra cleaning staff, we reserve the right to claim the extra cleaning costs from the damage deposit.

4. The tenant’s potential financial liabilities, if this agreement is not adhered to, will not be limited to the amount of the deposit.

5. If the booking is made within eight weeks of the letting, the whole of the rental payment is to be forwarded with your booking form.

6. If the booking is made prior to eight weeks of the letting 25% of the rental sum is to be forwarded with your booking form. The remaining balance of the rental sum is then due eight weeks prior to the letting. If payment is done through provider conditions may differ.

7. In case of force majeure the total of the rental deposit and all other monies paid (excluding bank charges) by the tenants will be returned to the tenants if a cancellation is requested any time before check-in. In a regular case if a cancellation is requested more than 14 days before check-in the tenants will get back 100% of the amount paid. If the cancellation is requested within 14 days and 7 days before check-in, the tenants gets back 50% of the amount paid. Otherwise, they won’t get a refund.

8. The number of people occupying the property may not exceed the number on the booking form, maximum of 8 adults. Any additional overnight visitor must be approved in advance during the booking process and are subject to an additional fee as noted in the price.

9. The property may not be used for a non-holiday accommodation purposes included any commercial activities or events, without explicit permission and written confirmation from the owners, or the owners’ stated representatives

10. If the tenant intends to hold a private, non-commercial event at the property that will be attended in excess of 15 people, explicit permission and written confirmation from the owners is required. Parties and large gatherings of any kind are strictly prohibited at the property. The tenant is responsible for ensuring maximum visitors numbers are not exceeded; and that visitors are complicit with these Terms and Conditions (resp. the house rules).

11. The property is provided to the tenant only for the purpose of holiday accommodation and for the use of the stipulated contracted tenants only. The property cannot be rented/hired to any third party by the tenants without explicit permission and written confirmation from the owners.12. For the avoidance of doubt, if explicit permission and written confirmation is given from the owner for non-holiday accommodation related usage, or for rental/hire to a third party, it is entirely the responsibility of the tenants to provide relevant insurance cover.

13. The tenant agrees to keep the property and all fittings, furniture equipment and other contents, in or on the property, in a like state of repair and condition as at the commencement of the letting and will make good (or will arrange with us to make good) any damage, breakage, or loss that may occur during the period of letting.

14. The tenant agrees to keep the gardens and outside facilities in a like state of repair and condition as at the commencement of the letting and will make good (or will arrange with us to make good) any damage, breakage, or loss that may occur during the period of letting. This clause extends to but is not limited to: the swimming pool and surrounding area, gardens and plants, Electronic Entry Gate, fencing, boundaries and exterior paved areas. For the avoidance of doubt, any glass breakages in and around the swimming pool may require significant work to rectify (pool drainage/pumping system replacement, etc.) and the tenant agrees to accept liability for all related costs, to make good.

15. The property is equipped with air conditioning. Doors and windows shall be closed when either air conditioning or heat is in operation.

16. The property includes a private outdoor pool. The use of the pool is at the tenant’s own risk. The tenant and his/her guest(s) acknowledge that the management does NOT provide lifeguard supervision. The tenant understands that the area surrounding the pool is not fenced or secure and there are special risks that may be involved. In particular, but without limitation, the tenant understands that the pool may present dangers to children who are not carefully supervised, as well as the danger if any person uses the pool for too long a time, has health problems, or is intoxicated or using any kind of drugs or medication, or uses the pool if pregnant. The tenant agrees to explain the risks of using the pool to any guests they may have at the property and to be fully and solely responsible for any accidents his guests may incur. The tenant understands the risks mentioned above and agrees that he will assume all responsibility for himself and his guests for the consequences of those risks. The tenant acknowledge and agrees that his/her use of the pool, as well as any other guests during the stay, will safely use the pool by not using glass containers in the pool area, running in the pool area, securing all doors leading to the pool, and supervising all small children while in and around the pool. The tenant agrees to waive any claim whatsoever against the owner for accidents or claims arising from use of the pool. The tenant agrees to indemnify and hold harmless the owner for any claims made by guest arising from guest’s use of the pool. The tenant also understands and agrees that he is responsible and liable and will pay upon request for any damages that occur to the pool and its support equipment through his or his guest’s misuse and/or negligence, for example, but not limited to, damaging the pool cover, or allowing the water level to become too low which can damage the cover. The tenant understands and agrees to be responsible and liable for any damages that occur to the pool and its support equipment through guest misuse and/or negligence. The tenant agrees to relieve and indemnify the owner and management of any and all liability for responsibility and compliance with pool barrier laws and regulations.

17. Pool heat is an optional amenity. The pool can be heated during the rental period at an additional cost of 50 EUR per day. The tenant shall inform the owner when booking resp. prior to arrival date to request pool heating. Short-term notice can result in a few chilly days in the pool. Please note: NO POOL HEATING WILL BE ACTIVATED WITHOUT SIGNED AGREEMENT AND PRE PAYMENT (unless otherwise agreed). If you choose to purchase pool heat, the heater will be turned on 24-48 hours prior to arrival. The pool will be heated to a temperature of 26°C to 28°C. Please note that weather conditions can dramatically affect pool water temperature and cause longer heating times than during warmer days. The pool heater operates on a timer and is scheduled to come on in the morning and go off in the evening. There will be some cooling off over night when the air temperature drops and/or with the wind. Therefore it is mandatory for the tenant to close the electric pool cover when the pool is not in use and especially at night. The thermic blades of the cover have a heating effect and keep the cool air and wind away from the warm water.

Because of safety reasons the pool cover needs to be completely reversed PRIOR to using the pool. When activating the cover resp. closing the pool nobody is aloud to use the pool. Tenant understands that the pool cover is to be handled with care and by adults only. Tenant may not adjust the pool pump, timers, heat pump, turn levels or push buttons on any pool equipment. If the tenant has any questions please contact the owner or management company.

18. Unless otherwise stated, the rental of the property includes rates, insurance of the property, water, gas and electricity. The property is equipped with crockery, cutlery, sheets, duvets and adequate cleaning equipment, linen and towels.

19. Holiday lettings are by the week (unless by prior arrangement) from 4 pm on the date of arrival to 10 am on the date of departure. The time lapse is to enable the property to be inspected in between lets and to ensure everything is in good order. Long lets can be arranged in advance.

20. The tenant agrees not to smoke, nor to allow smoking, inside the villa and the outside area surrounding property at any time. The tenant agrees not to smoke any substances, including vaping. Drugs are not allowed on the property.

21. The tenants agree to provide access to the cleaning team of our property manager Vilalaia Lda. to accomplish their services. If not otherwise agreed there will be a mid-week cleaning (cleaning of bathrooms, change of towels, top up amenities) and an end week general cleaning.

22. Tenants are asked to ensure that they take all belongings with them. On changeover days we rely upon the goodwill of our guests whose co-operation we greatly appreciate.
